discussion is closed and we will now vote on the motion.

The motion reads "I move that the MNIGS status be removed from Mr. Richard
Pettys' record."

Disciplinary Hearing Moderation of Disciplinary Hearing Respondent
6 July 2011
Mr. Daryl Lytton, the respondent in the current disciplinary hearing, was cautioned by the Chair regarding his actions associated with the hearing on 02 July and 4 July. You’ve continued in the same vein that earned you the moderation, so you’ve been moderated on the disciplinary hearing mail list and will remain moderated until the conclusion of the hearing. You may send messages of comments to the disciplinary hearing members to the Chair. If your messages are related to the subject being discussed, they’ll be forwarded to the list. If your messages contain further inflammatory or off-topic content, they will not be forwarded.

• Results of Disciplinary Hearing deliberations regarding Charge #2:

16 July 2011
The disciplinary hearing members have completed deliberations regarding Charge #2 and have found Mr. Daryl Litton guilty of the charge.

Members voting GUILTY: Sherri Bradley, Tina Vickery, Cyndie Enfinger, Bill Oliver, Ann Allen Geohagen, Les Shockey, Jeff Kemp, Denise Wells, Linda Lewis

Members voting NOT GUILTY: Alice Allen, Nancy Beach, Pat Asher

Members voting ABSTAIN: Pauli Smith

Members recused: Dale Grimm

The penalty agreed to by the members is:

Mr. Lytton is forbidden from submitting any grievance to the USGenWeb Grievance Committee for a period of two years beginning July 16th, 2001. The Grievance Committee is hereby instructed to refuse without comment any Grievance submitted by Mr. Lytton during this two year period.

The Disciplinary Hearing will continue with commencement of the Evidentiary Phase for Charge #3.

Completion of Disciplinary Hearing deliberations regarding Charge #2
The members of the Disciplinary Hearing have completed their deliberations on Charge #3, and have found the respondent, Mr. Daryl Lytton, guilty.

The vote was as follows:

GUILTY: Sherri Bradley, Tina Vickery, Cyndie Enfinger, Pauli Smith, Bill Oliver, Ann Allen Geohagen, Lesley Shockey, Jeff Kemp, Denise Wells, Pat Asher, Linda Lewis

NOT GUILTY: Nancy Beach

Abstain: Alice Allen

Recused: Dale Grimm

After the determination of guilt, the members further deliberated as to penalty/punishment. With only Bill Oliver voting to disagree, the members determined the following penalty/punishment:

"The disciplinary hearing members have completed deliberations regarding Charge #3 and have found Mr. Daryl Lytton guilty of the charge. The penalty agreed to by the members is:

That, due to the egregious nature of the offense, Mr. Lytton's membership in the USGenWeb Project is suspended pending the conclusion of the hearing process. The suspension of Mr. Lytton's membership includes (1) Grievances to the GC will not be accepted; (2) Appeals to the AB will not be recognized; (3) Comments and/or questions, with the exception of those dealing with this disciplinary hearing, will not be acknowledged; (4) he will be removed as a subscriber to any national and regional level mail lists; (5) even if he holds any position in a State project, he will not be subbed to the State-Coord list nor listed on the national site as such. All state-level XXGenWeb Projects are encouraged to suspend Mr. Lytton from any and all state-level positions until the hearing is concluded.

As requested by Mr. Lytton, the remaining charges (4-8), will continue to be considered separately insofar as guilt or innocence is concerned. The penalty for any additional charges of which he is found guilty will be considered and applied as an aggregate penalty at the conclusion of the hearing."

This message will be posted to BOARD-L as a public announcement after this preliminary posting.

Following the public announcement, Mr. Lytton will again be subscribed to the hearing list for the commencement of the Evidentiary Phase for Charge #4.
